After the long tiring process of gaining U.S. entry, you will have many options open to you. You may be seeking U.S. permanent residence, or you may wish to update your residency status. Whichever category you fall in, Form I-485 is just what you need. 

What Is Form I-485? 

This form is the application to register permanent residence or adjust status. It helps an immigrant to secure a green card. It is an application that allows an immigrant to gain permanent residency status. 

Who Should File Form I-485? 

Form I-485 is important to all immigrants. But, it is not available to all. The first rule is that you must be domiciled in the U.S. However, you may belong to one of these groups: 

  • Principal Applicant: This is the beneficiary of an immigration petition(Usually Form I-130 for family-based, or Form I-140 for employment-based). It also refers to qualified residents of the U.S. 
  • Derivative Applicant: The spouse or children of the principal applicant, may file the Form I-485. While they may not be direct beneficiaries, their relationship with the principal applicant makes them eligible. 
  • Others: This category caters to persons who are neither principal nor derivative applicants. There are many, many narrow categories that apply here. 

The first question you must ask is, “Do I qualify to file Form I-485?”. You must fit into one of the categories, and be able to prove it. 

The second question is, “Can I file Form I-485 now?”. Even if you otherwise qualify, if you don’t file at a time when a green card number is available to you, your case will be rejected. 

The third question is, “Is there any reason why my Form I-485 could be denied?”. This is a very broad question: it can include mistakes in your immigration history, a criminal record, other ground of inadmissibility, or even a decision by USCIS that you don’t deserve a green card.  

If you do not have absolutely clear answers to the above three questions, STOP. Do not file Form I-485 and make an appointment with an immigration lawyer immediately. 

Just because the form is there, doesn’t mean you can file it! 

Simple Instructions For Form I-485 

Assuming you do qualify, and it’s the right time, and you have no bars to approval, you first need to secure a copy of the form. So, click here to download the form from the USCIS website. 
If you cannot access the USCIS website, you can request a printed copy of Form I-485. Simply call the USCIS Contact Center on 1-800-375-5283. 

  1. Answer all questions correctly and truthfully. Furthermore, If a question doesn’t apply to you, type or print “N/A” in response. 

  2. All USCIS forms must be filled in black ink. Form I-485 is no exception, and you must type or print legibly in black ink.  

  3. Ensure that your signatures are handwritten. Stamped or typewritten signatures are invalid and will face denial. 

  4. If you need extra space to complete any item in the Form, use the space provided in Part 14. If that is insufficient, attach a separate sheet of paper with your name and A-Number boldly written on it. Moreover, be sure to highlight the page, part, and item numbers to which your answer refers accordingly. Also, put the date and your signature on each extra sheet.

  5. You must submit all evidence and supporting documentation at the time of filing the form. Submit only duplicate companies of your documents, unless USCIS says otherwise. 

  6. Ensure that all documents are in the English language. If you have documents in another language, you must submit the foreign-language documents as well as a certified English translation. 

Simple Instructions For Form I-485

Form I-485 Fee and Processing Time 

The USCIS Form I-485 has a filing fee of $1,140. Many times, however, a separate biometric fee must also be paid. This fee is currently $85. NOTE: Filing fees change frequently! Check the USCIS website (not the form instructions on the form) to determine the correct filing fee. 

Form I-485 processing time varies greatly. Sometimes it can take just a few months, other times it may drag on for years. However, you may experience a delay if your immigrant visa number becomes unavailable (assuming it was available at the time of filing), or you’re lacking in other crucial documents. 

Cons Of Filling The Form Incorrectly 

Should you fail to file the form correctly, you will face certain penalties. After a denial, if you are left with no lawful status in the US, you may be placed into removal proceedings for deportation. If you didn’t review the submitted documents and it turns out any document or statement was false, fraudulent, or otherwise misleading, you may be barred as inadmissible and may even be subject to criminal prosecution. This depends on the gravity of your error – particularly forgery or submission of fake documents.  

We don’t say this lightly: Form I-485 may be the most important form you ever file in your life. Permanent residence is unlike any other visa status and is generally the only way to obtain citizenship. Every question on the form has a body of law and policy behind it, and unless you know what and why questions are being asked, you run the risk of giving a wrong answer. Wrong answers will hurt you.
