In Virginia the main detention facilities are FarmvilleRappahannock, and Hampton Roads.  In Maryland, there is Worcester County Detention Center.  Many DC-area cases get transferred to York County Prison.

There are several forms of relief that are available: asylum, withholding of removal, cancellation of removal, adjustment of status, deferral of removal, waivers under section 212(c), 212(h), 212(i), and others.  Each one has its own requirements which must be met and are strictly enforced..  But you also have to show “discretionary eligibility” – that is, you’re saying, “I not only meet all the requirements, but I deserve this form of relief from removal.”

Removal proceedings take time.  The best thing to do is to be mentally prepared for a long battle, and also to use the time to strengthen your case.  Circumstances change and strengthen cases.  Each case is absolutely unique and the wise attorney will creatively think out of the box to build a customized case that maximizes the chance of success.
